Kirk is an appellate lawyer who regularly litigates in the state and federal appellate courts serving Texas and New Mexico, helping trial attorneys to protect six- and seven-figure victories when needed and avenge their defeats when necessary. He has served as lead appellate counsel in cases before the Supreme Court of Texas, the New Mexico Court of Appeals, the United States Court of Appeals for the Fifth Circuit, and the Texas state intermediate courts of appeals. As the former chief staff attorney of the Texas Eighth Court of Appeals with insight into local practice, Kirk also serves as local counsel to out-of-town attorneys appearing before the El Paso court..

During his tenure as chief staff attorney for the Texas Eighth Court of Appeals in El Paso, Kirk was the Court's mandamus and emergency proceedings attorney, personally handling all requests for stays and emergency relief as well as a select docket of high-profile injunction appeals, extraordinary writs, and Election Code mandamus actions within the Court's original jurisdiction.
Kirk has served as embedded appellate counsel on trial teams litigating cases in Texas and New Mexico, especially in cases involving complex procedural issues like governmental immunity that are likely to be appealed before trial, and high-dollar cases that are subject to extensive post-judgment litigation after trial.
